Special Conditions

• • Smoking is not permitted in the interior of the vessel.
• • It is the charterer's responsibility to ensure that he and his guests hold current valid visas for all countries visited during the charter.
• • Children are to be under the supervision of an adult in the charter party at all times.
• • Any damage caused by a guest to the yacht and its equipment shall be paid for by the charterer or the broker.
• • A crew gratuity is customary but is given at the charterer’s discretion.
• • The VAT is included in the Charter Fee.
• • Any outstanding APA accounts will be settled with the Captain onboard and in cash before disembarkation or via bank transfer 3 days before disembarking.
• • All incurred bank charges are at the charterer's expense.

Cancellation

Any cancellation before the start of the Charter Period must be made in writing to the owner. The following terms shall apply:

A. CANCELLATION BY THE CHARTERER: If the charterer cancels before the start of the Charter Period, the owner may retain any amounts paid by the charterer as of the date of cancellation and any amounts due but unpaid as of the date of cancellation will remain payable. The owner and the broker shall use reasonable efforts to book a new charter for all or part of the Charter Period. If the owner books a new charter for all or part of the Charter Period, the charterer will receive a refund equal to the net proceeds of the new charter after deducting 20% of the Charter Fee (covering the broker's commission,and administrative costs) and any expenses incurred by the owner due to the charterer's cancellation for the cost of provisions and special requests. If, despite reasonable efforts, the owner is unable to book a new charter, the charterer will receive no refund.

B. CANCELLATION BY THE OWNER: if the owner gives notice to cancel for any reason other than Force Majeure, then the owner shall reimburse the charterer (through the broker) for the full amount of all payments made by the charterer. The owner shall pay all commissions due to the broker.
